KARACHI, 24 June — The Sindh High Court has dismissed a petition challenging the appointment of Gen. Pervez Musharraf as president, saying the head of state enjoyed immunity under Article 248 of the country’s constitution.

However, the petitioner, Sohail Hameed argued that by elevating himself to the presidency the general had violated the constitution. He recalled that the Supreme Court while validating the military action last year, had barred Gen. Musharraf from making any major amendments to rules for state governance.

Gen. Musharraf is trying to introduce the presidential form of government in defiance of the apex court ruling which said that the parliamentary form of government will not be changed. The office of the high court, which normally accepts the petition, has returned it after scrutiny. (S.H.)
