BHOPAL, 17 September 2004 — A Bhopal court has registered a case of contempt of court against the Board of Control for Cricket in India, (BCCI), for violating the court’s previous order restraining it from taking any decision outside its rule book on the appointment of its president Jagmohan Singh Dalmiya as the BCCI’s patron-in-chief.
The Bhopal court of civil judge P.K. Nigam on Wednesday allowed the application for contempt of proceedings ordered issuance of notices to BCCI under Order 39 Rule 2-A of the Civil Procedure Code of India for disobedience and breach of injunction order passed by the court earlier. The next date of hearing is October 5, 2004 when the BCCI has to appear in court and submit its reply. The judge had reserved order yesterday after hearing the preliminary arguments of the plantiff’s counsel Ajay Gupta.
The application for contempt of court proceedings has been filed by Bhopal Division Cricket Association member Yogesh Khattar in his personal capacity. It has been alleged in the application that Dalmiya’s appointment as patron-in-chief till 2007, at a BCCI meeting in Madras on Sept. 12, amounted to contempt of court.
