Maulvi Iqbal Haider was the citizen who had attempted to take legal action against Zardari.
However, Justice Hamid Ali Mirza told him that only the chairman of the Senate was authorized to refer any move that challenged the electoral eligibility of the president.
"It is not the case in which every citizen can offer such petitions. The Constitution clearly states any such reference should be routed through the chairman of the Senate,” Mirza said.
Haider had claimed that Zardari should have been disqualified as a candidate for Pakistan’s highest office after the Supreme Court declared the National Reconciliation Ordinance as void and unconstitutional.
"The presidential election has constitutional indemnity and cannot be challenged. If President Zardari is a convicted person, then that is a matter for the court to decide," Mirza added.
