TAIF: A court should officially inform both the man and the woman about the divorce order issued by it, according to the latest regulations issued by the Ministry of Justice.

The new regulations were sent to the judges in all the courts in the Kingdom after the approval of Justice Minister Abdullah Al-Asheikh, Al-Madinah daily reported yesterday.

The new regulations governing the divorce law stipulate that the divorce order would become effective only if the husband supplied clear address of the divorced woman or her legal guardian to the court’s administrative office. The court should also deliver a copy of the order to the divorcing husband and the divorced wife. Another ruling in the divorce regulations is that a husband, who intends to take back his former wife, should submit the original document used in the divorce.

The ministry’s instructions also said that a woman who intends to file a complaint on issues related to her marriage is eligible to file her suit at a court in her town or the town of the other party. This is also applicable in cases of women who are being prohibited from marrying by their male relatives.

The new regulations also said that the court should verify if a debtor has movable and immovable properties before jailing him. The judges should also order for inquiries regarding his properties with due consideration of the information supplied by the creditors.

The judges have also been directed to use precise and candid language without resorting to embellishment while issuing judgments.

The ministry’s directives also authorized the courts, which look into the violation of public rights in traffic accidents, to look into the violation of private rights resulting from the accident.

The new regulations also stipulate that any one requesting a dependency certificate should produce an official letter from his employer. If he is not a government employee, the application should accompany a declaration that he is not a government employee in the format supplied by the Ministry of Justice.

The applicant should also specify the purpose for which the certificate is required.

The ministry also directed the judges that any query from a government department regarding a matter outside the court’s jurisdiction should be referred to the ministry for appropriate decision.

It also said that the head of a court’s records office should ensure that every record is signed by concerned judges. He should give monthly reports to the court’s president about unsigned records, the newspaper reported.
