Pune based social activist Hemant Baburao Patil who filed the PIL afresh in the Bombay High Court in his petition alleged that Chavan had not disclosed details of his Wadala flat while filing his nomination for the Rajya Sabha (Upper House) polls.

Patil who claimed to be the president of National Anti-Corruption People's Front, had moved a similar plea last December in the Bombay High Court, but was advised by the judges to approach the Election Commission of India with his grievance.

The petitioner in his fresh pleas told the court that he had approached the Election Commission but the commission had taken no cognizance of his complaint. Patil further stated in his plea that Chavan had furnished false affidavit before the concerned authorities and thus violated the provisions of the Peoples Representative Act and demanded that action against Chavan be taken under the provisions of the Indian Penal Code (IPC).

Patil prayed to the court that an inquiry against Chavan be ordered and legal action be initiated against the chief minister. He also brought to the notice of the court that he had in spite of writing to the chief election commissioner and Maharashtra chief electoral officer, as advised by the court earlier, both the election commissioner and the electoral officer did not initiate any action against Chavan.

"While the flats in Venus Cooperative Society in Wadala are meant for the BPL citizens, Chavan had mentioned in his affidavit filed for the Rajya Sabha polls falsely claimed that he belonged to the BPL category. Chavan has completed his higher education in the United States, then how he claims to be falling into the BPL category," Patil questioned in his petition.

Chavan in his application for the flat in the Society had mentioned that he belonged to the Higher Class Category (HCC) an that his monthly income was 76,000 rupees which comes to 8,00,000 rupees annually. However, in the flat allotment letter it was mentioned that the flat to Chavan was allotted from the BPL housing category quota.

The allotment of flat to Chavan from the BPL category had stirred a controversy soon after he took over as the new chief minister of Maharashtra. When the media questioned Chavan about the controversial flat and the non disclosure of the same in his Rajya Sabha poll affidavit, Chavan went into a defense mode and stated that the flat was given to his late mother Premalatai Chavan, a former MP and state unit chief of the Maharashtra Congress, as a special gesture by the government as she was seriously sick.

A congress leader told Arab News that Chavan is on a sticky wicket and the court case would embarrass and taint the Congress black, as former Congress chief minister and Chavan's predecessor Ashok Chavan too had to quit in disgrace for his involvement in the controversial Colaba located Adarsh Housing Society scam.
