Jusoorul Khair Foundation for Commercial Services has lodged the complaint to get SR89 million in back payment from the Disabled Society. Officials at the charity, however, deny the allegations. The court is to hold its next hearing on the case on June 15 and has asked the charity to produce its previous bank statements from the time the contract was signed to the present day.

Ali Ba Homaisha, the lawyer representing Jusoorul Khair Foundation for Commercial Services, said his client successfully undertook a fund-raising campaign for the charity — titled the National Campaign for Combating Disability — in 2007.

He added that the Foundation was directly responsible for donations that were deposited directly into the charity’s bank account and that it was promised 30 percent of total contributions.

“My client was instrumental in getting donations of over SR150 million from philanthropists and charities … However, the charity failed to fulfill what it was obliged to do and failed to pay the company remuneration for undertaking the campaign,” he said.

He added that the charity annulled the contract at the end of 2009 without prior notice, and refused to pay arrears. He also said the marketing company has produced details of money that has been deposited in the society's account as a result of the three-year campaign. It is also demanding an unspecified amount of compensation for other damages, including mental anguish.

The charity’s chairman, Abdullah Al-Mogamis, denied the charges. “The amount of money deposited in our account as a result of the campaign was not as much as is being claimed by the foundation," he said.

He added that the charity was forced to cancel the contract due to several problems with the marketing company. “We were keen to comply with a directive issued by the Eastern Province Governorate to solve the issue within six months. However, the Foundation closed the doors for settling the issue in an amicable way by taking the issue to court. That was only two months after the governorate issued its directive,” he added.
