DUBAI, 29 January 2008 — An Emirati man, who claimed a baby born to his wife was not his as he was unable to have children, has lost his court case.
The UAE Higher Federal Court upheld a lower court verdict rejecting the man’s claim and ruled that the child be officially registered as his son. It also granted the man’s wife a divorce, awarded her alimony and ordered the father to pay the mother’s legal fees.
According to court records, the couple married legally in April 2003 and consummated their marriage in July 2004. The man then abandoned his wife in August 2005, a month before she gave birth, and filed an adultery case against her.
The woman, on the other hand, filed a case against her husband saying he had slandered her and ruined her reputation. She also filed for divorce, asked a court to register the child in her estranged husband’s name and demanded maintenance for herself and her child.
In November 2006, the Court of First Instance ruled in favor of the mother, granting her a divorce and her other rights. It also ruled that the man was the child’s biological father.
The man appealed and provided certificates from doctors, which stated that he could not have children.
