JEDDAH: A court in Madinah has asked the elder step-brother of several children to handover them over to their mother after the death of the father, with the order to be implemented immediately.
Anyone obstructing implementation of the order will be given three months’ in jail, according to the court order.
An elder brother — not the real brother — who was living abroad had returned to the Kingdom after the death of his father. He ousted the wife of his father from the family house and hid the children, the youngest of whom is just one year old, as the wife did not have any relatives in the country.
The mother informed the court that she had been living with one of the neighbors since Thursday. The court asked her to be accommodated with the care committee and ordered the arrest of the elder brother before he could leave the country.
He told the court that the children were with his mother who could take better care of them. He accused the mother of these children of practicing black magic.
Then the court ordered him to hand over the children immediately to their mother, who is a non-Saudi, and also asked him not to confront her or her children in the future. The court also decided the matter of inheritance in the case.
The court based the decision on the saying of Prophet Muhammad, peace be upon him, that the one who would separate a mother from her child would be separated from his beloved on the day of judgment.
The court also believed that separating the mother from the children would harm all of them.
