ISLAMABAD, 25 December 2007 — The Supreme Court of Pakistan yesterday struck down an order of the Lahore High Court (LHC) that prevented the establishment of a high court in Islamabad.
After the imposition of the state of emergency President Pervez Musharraf had ordered the establishment of a separate High Court for the Islamabad Federal Capital Territory. This was challenged at the Lahore High Court.
Pleading for suspension of the Lahore High Court order Attorney General Malik Mohammad Qayyum told the top court the High Court had no jurisdiction to suspend the constitutional amendment made by the president during emergency.
He said the top court had upheld the emergency measures, including setting up of the High Court in Islamabad. The four-member Supreme Court bench will hear the case again on Jan. 7.
