RIYADH: The National Society for Human Rights (NSHR) has intervened in the case of a Saudi woman who has, through a viral video, sought help to save her marriage following a court order for separation from her soldier husband on the ground of incompatibility in lineage, according to a website.

The NSHR said that after a marriage has taken place, the girl’s father, brother or relatives do not remain her guardian and thus cannot demand a separation.

A source said that the society was following up on the wronged woman’s case with the authorities concerned and is confident that justice will be done.

The source said that if a couple is separated for this reason, it harms the children and society.

The Supreme Court has never supported separation for this reason as it leads to disintegration of families. In such cases, it bases its judgment on the rationale and customs, which do not demand separation as Islam stresses equality, said the source.

“We hope that a system would be developed that halts hearings in the cases wherein the annulment of nikah is sought for the reason of incompatibility in lineage, particularly those cases where couples have children,” the source said.

Mohammad Al-Jazlani, a former judge and legal advisor, told the website that the case was not in line with the sayings of Prophet Mohammad, peace be upon him, as has been mentioned by Imam Ibn Al-Hajar in his book Fathul Bari and other experts of Hadith or prophetic traditions.

Sheikh Mansour Al-Gifari, adviser and spokesman at the Justice Ministry, said the principles and judicial verdicts do not separate couples on the ground of incompatibility. Compatibility should only be in religion as has been said in the Holy Qur’an and the Sunnah.

Commenting on what has been spread in the media about the case of Al-Aiyyenah Court, he said it was just an initial judgment, not the final one. “Parties in the case can move a higher court.”
