The trial of an Asian maid who is accused of killing a Saudi child, Mishari Alboushil, is back to the square one following the recent return of the case from the Court of Appeal after 20 months of legal procedures.

The initial ruling of the General Court in Dammam had acquitted the Indonesian maid, yet the decision was overturned during a subsequent appeal.

The victim’s father, Ahmad Abdulrahman Alboushil, was taken aback at the decision of the court to restart the case, local media reported.

Reconsidering the case will involve reformation of the lawsuit committee.

The Court of Appeal did not only overturn the judgment issued by the General Court in Dammam, but also referred the case to the Ministry of Justice.

The hospitals — Armed Forces Hospital in Dhahran, Riyadh Military Hospital and King Fahad Specialist Hospital — will collectively form a medical committee consisting of six doctors to extract a legal document to be added to the previous reports.

The General Court has earlier acquitted the maid on the grounds that the three medical reports issued by the three hospitals did not explicitly state that the child was poisoned. In addition, one of the reports stated the child was suffering from a genetic disease, which caused his death and the reports were contradictory on the causes of poisoning.

The public prosecutor objected to the decision of the General Court immediately after it was issued and the case was referred to the Court of Appeal.

The 4-month child had died five years ago. The maid was accused of mixing rat poison to his milk bottle while the mother was away. The health condition of the child deteriorated. Doctors at the hospitals in the Eastern Province and Riyadh tried to save him, but the he died one-and-a-half-month later.
